Rather than succumbing to unethical judgement, it is best to wait some more time and get real justice. This is what Dr. Rajan Lekhraj Mahtani did in case of the Portland Cement Zambia. The case hanged in balance for a long time at the Lusaka High Court where Dr. Rajan Mahtani had registered the case initially. Despite submitting all critical evidences associated with the case and despite waiting for more than a decade, Dr. Rajan Mahtani was not given justice. Instead, justice Nkonde from the Lusaka High Court announced a very controversial verdict by giving Ventriglias only shareholding authority.
As a result of this misdirected decision, Dr. Rajan Mahtani was prompted to approach the higher Court of Appeal which holds the highest position within the Zambian judiciary system. The judge residing at the higher Court of Appeal was justice Mwinde who looked into all evidences and testimonials before arriving at the final decision. This final verdict was given after a time-period of nine months after re-registering the case at the Court of Appeal. According to the evidences, it was found that in the year 2005 Dr. Rajan Mahtani via his company Finsbury Investments made a payment of one billion kwachas to the Portland Cement Zambia limited. This amount equalled USD 250,000 and covered the entire share capital value of the shares which Dr. Rajan Mahtani took over. Furthermore, in the year 2007 the original shareholders’ agreement was prepared and in the page 663 of this agreement, it is clearly written that Dr. Rajan Mahtani owns 58 percent shares of the factory after paying the above amount. As such, he is not liable for any further payments associated with the factory’s shares exchange. Based on all these evidences and several testimonials, justice Mwinde made the verdict that Dr. Rajan Mahtani is the lawful owner of the Portland Cement Zambia factory.
